County Registrar Lists Hilary 2021
Further to the statement of the President of the Circuit Court Published on21 October 2020 and the Dublin County Registrar Notice published on 21 October 2020 and due to the current provisions of the Health Act 1947 (Section 31A -Temporary Restrictions) (Covid-19) Regulations 2020.
Steps have been taken for the listing for hearing of Taxation of Costs and Landlord and Tenant (Ground Rent) applications and the Notice published on 24th June 2020 remains in place. Matters will not be listed for hearing without compliance with that notice even if dates have been assigned.
Taking of Foreign Evidence hearings will continue as normal.
Nursing Home Support Scheme Act 2009 applications for the appointment of Care Representatives will be listed in staggered hearings and applications for marriage exemptions will be dealt with in staggered hearings.
Civil Motions will be listed for hearing in staggered hearing lists. Those civil motions adjourned from 21 October 2020 to 1 December 2020 will be listed for hearing on the next available dates in 2021 and Notices will be published in the Legal Diary in due course regarding the relisting of the adjourned civil motions.
Arrangements are in place to ensure compliance with HSE distancing requirements and your cooperation is appreciated. To comply with social distancing requirements staggered times have been allocated for practitioners to attend Court for the hearing of these matters. You must only attend Court at your scheduled time. The hearing will take place in accordance with public health and the Courts Service guidelines.
PLEASE NOTE THE FOLLOWING FOR CIVIL MOTIONS
- Attend court at the appointed/designated time as there are no waiting facilities. There will not be a second call due to the current restrictions.
- Only one representative for each party to attend court, who must be able to deal with the matter.
- The parties must leave court and take all belongings at the expiry of the allotted time.
- All affidavits and exhibits musts be filed in the Circuit Court Civil Office 5 working days prior to the hearing. The moving party must lodge in the Civil Office a clean, complete, indexed and paginated book of pleadings and proceedings for the court for the application 5 working days prior to the hearing. Documents will not be accepted in Court. When filing documents for upcoming court attendance ensure the Court Office is notified of the correct record number, date and time of hearing of the matter. Please clearly indicate on envelope the court date the court papers refer to.
- Where a party to the Motion is a lay litigant the solicitor for the other party must inform the lay litigant of the hearing date and time.
- The consent email address cannot be used for County Registrar Motions and all applications for orders on consent must now be made in court when the motion is listed for hearing.
POSSESSION PROCEEDINGS
Possession Civil Bill lists have been adjourned since 19th March 2020 as per the Order of the President of the Circuit Court. Any party now wishing to have an affected Possession Civil Bill listed for hearing must complete the attached Questionnaire and submit it to the Dublin Circuit Court Office with a complete indexed and paginated book of pleadings and proceedings and a letter to the other party setting out that a date for hearing is being sought. Once the completed questionnaire and book of documents is received the Civil Bill will be relisted for the next available Thursday . The party applying for the hearing date will be notified and that party must notify the other party in writing of the return date not later than 10 days prior to the hearing date.
All other Possession Civil Bills previously adjourned by the said Order of the President of the Circuit Court will stand adjourned to Easter Term 2021 where dates will be assigned in staggered listings and published on the legal diary in due course. The moving party must notify the other parties in writing of the hearing date and time.
For any newly issued Possession Civil Bills a Questionnaire must be completed and lodged in the Dublin Circuit Court Civil Office prior to the return date for the Civil Bill.
The possession civil bills will be listed for hearing in a staggered hearing list. Please notify the other party of the time for the hearing.

- The parties must leave court and take all belongings at the expiry of the allotted time.
- All affidavits and exhibits musts be filed in the Circuit Court Civil Office 5 working days prior to the hearing. The moving party must lodge in the Civil Office a clean, complete, indexed and paginated book of pleadings and proceedings for the court for the application 5 working days prior to the hearing. Documents will not be accepted in Court. When filing documents for upcoming court attendance ensure the Court Office is notified of the correct record number, date and time of hearing of the matter. Please clearly indicate on envelope the court date the court papers refer to.
- Where a party to the Civil Bill is a lay litigant the solicitor for the other party must inform the lay litigant of the hearing date and time.
- The consent email address dublincircuitcivilconsents@courts.ie can be used to seek orders striking out possession civil bills on consent only for matters that do not currently have a hearing date. Once hearing dates are assigned the matter can only be dealt with in Court on the date assigned for hearing. In order to have such an Order a copy of the first page of the civil bill, the date that the Civil Bill is next listed before the Court, written consent of the other party/parties to the order being sought and the exact terms of the Order sought must be emailed in a single email. If this is not done the email will not be acted upon.

Family Law motion lists and lists to fix dates and Case Progression will continue in staggered sittings. Please watch the Courts Service website www.courts.ie for further update.
Further, as per the Order of the President of the Circuit Court dated the 6th April 2020, where cases are settled and require to be struck out or consent orders need to be ruled, these will continue to be dealt with by email requests from both parties and will be ruled by the County Registrar without the necessity of parties being present in court.
As per the Notice of 09/04/2020 the following dedicated mailboxes have been set up to deal with such consent applications only by the County Registrar for Dublin.

The request must include a copy of the application before the Court, the written consent of the other party to the application (if there is a party on notice) the relevant exhibits and the exact terms of the Order sought on consent. This email address cannot be used for matters listed for hearing before the County Registrar and the parties must attend court when the matter is listed before the County Registrar to seek orders in such cases.

This email address cannot be used for motions listed for hearing before the County Registrar or before a Judge or for trials listed within 14 days of the date of application and the parties must attend court to seek the orders at the appropriate time or contact the Dublin Circuit Court Office for further information. All information must be contained in a single email. Where all information is not provided the order will not be ruled and the email will not be replied to.
Please ensure all consent applications are directed to the appropriate designated e-mail address as they will not be dealt with if sent to the incorrect email address.
