Circuit Court Update - Notice in relation to amendment of Section 21 (Appointment of Care Representatives in case of a person not having full capacity), Nursing Home Support Scheme Act, 2009.

Section 21 (Appointment of Care Representatives in case of a person not having full capacity) of the Nursing Home Support Scheme Act, 2009  will be amended by the Assisted Decision Making (Capacity) Act, 2015 (ADMC).  The amendment will change the process of making an application under the scheme.  The legislation due to commence in mid-November has been delayed.  No new commencement date is currently available.  It is expected that commencement will only be delayed for a short period and an update of the new commencement date will be published once we are notified of it.   Offices will continue to accept new Section 21 applications in the meantime but it is strongly advised that new applications are made as soon as possible to ensure that they can be dealt with in good time before ADMC legislation comes into effect.   This notice supersedes all recent notices relating to Section 21 applications.
