It is important to know that you cannot apply to the court for a personal insolvency solution on your own. You must work with a representative who is authorised to handle applications. They will represent you throughout the process.
How to prepare
You should seek advice from MABS or the ISI about the type of debt you have. They can help you find the personal insolvency solution you may be eligible for.
Depending on your situation, you will need to contact either an approved intermediary (AI) or a personal insolvency practitioner (PIP);
- An AI is authorised to make debt relief notice (DRN) applications.
- A PIP is authorised to make debt settlement arrangements (DSA) or personal insolvency arrangement (PIA) applications.
How to apply
Once you have agreed on an insolvency solution, your AI or PIP will submit your application to the ISI. The ISI will make an application to the court to approve your insolvency solution. You will never be asked to attend court yourself, but you can attend if you wish.
