Practice Direction continuing the operation of certain Rules of the Superior Courts relating to Wards of Court

I, David Barniville, President of the High Court, hereby issue the following Practice Direction in accordance with the general authority of the President of the High Court and s. 11(12) and (13) of the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020.

Purpose of this Practice Direction  

1. Notwithstanding the deletion of Order 67, Order 70A Rule 26(2), Order 79 Rule 26, Order 117A Rule 4(c), Order 134A Rules 14(1) and (2), and of Forms 1 to 18 in Appendix K from the Rules of Superior Courts, which deletion takes effect from the 24th day of April 2026 as provided for in the Rules of the Superior Courts (Assisted Decision-Making (Capacity) Act 2015) 2023 (S.I. 261 of 2023),

(a)  The provisions of and the procedures set out in the following orders and rules of the Rules of the Superior Courts shall continue to apply where necessary to the person and estate of every adult ward of court pending his or her discharge from wardship:

  • Order 67, rules 1, 3(2), 3(3), 48, 49, 51, 55 to 60, 65, 69, 80 to 92, 94 to 104
  • Order 70A, rule 26(2)
  • Order 79, rule 26
  • Order 117A, rule 4(c)

(b)  The following forms in Appendix K to the Rules of the Superior Courts shall continue to be used where appropriate:

  • Form 1 (heading in Wards of Court matters)
  • Form 15 (affidavit of service)
  • Form 17 (conditions of sale)
  • Form 18 (declaration by relative of a ward dying intestate)

2. This Practice Direction will come into operation on 29 April 2026.
