Family Law Civil Bill – key information required

This document is intended as a guide to outline the typical minimum key information that is needed in a completed Family Law Civil Bill that you wish to file with the Courts. The contents of this document do not constitute legal advice.

Indorsement of Claim

An Indorsement of Claim should include much/all of the following:

  1. The Applicant and the Respondent were married on the   day/month/year at   (state location)
  2. The Applicant and the Respondent have lived separate and apart from each other since  . After the breakdown of the marriage, they resided at  .

    The Applicant now resides at   and the Respondent resides at  .
    If the applicant currently owns the property they reside at please provide the folio number here:  
  3. The Applicant was granted a   (insert details of any judicial separation/separation agreement/church annulment / District Court Orders), a copy of which is annexed hereto.

  4. There were no children of the marriage
    OR
    The names and dates of birth of the children of the marriage are as follows:  
  5. The Applicant and the Respondent at the time of their marriage resided at   (specify the type of accommodation i.e. rented/owned/with parents etc.). If the property forms part of the proceedings, please state the folio number:  
  6. Both the Applicant and the Respondent reside within the jurisdiction of this Honourable Court. (amend where appropriate. Note, if the Respondent resides outside of the jurisdiction, please specify if they are an Irish Citizen or not)

Applicant Claims

You need to make it clear to the court what the primary order you are seeking is, along with any additional orders.

In an application for Divorce, the Applicant Claims would typically include a claim for a primary order as outlined below. You must include details of ALL orders you are seeking from the court.

Important: if you are unsure as to the orders you wish to claim, we can only recommend that you seek legal advice in relation to the applicant claims as set out in your Civil Bill.

AND THE APPLICANT CLAIMS:
