How does service of documents work?

Documents can be served either digitally through the Courts Portal or by traditional physical methods.

When serving documents digitally, there are two steps:

  1. Issue the documents for service. Select the party you wish to serve and provide an email address. If the party is represented by a solicitor, you can provide the solicitor's email address instead.
  2. Track delivery. You will receive a notification when the recipient accesses the served documents, or after 72 hours if they have not yet been accessed. If the documents have not been accessed, you may wish to serve them using another permitted method.

Can I serve exhibits?

Yes. Exhibits can be uploaded to the Courts Portal and included when serving documents digitally.

Exhibits are not filed with the court or visible to court staff. You should retain the original copies of any exhibits that you upload.

Do I need to file proof of digital service?

Yes. The Courts Portal allows you to file proof of service and automatically generates evidence of digital service to support your filing.
